Every supplier says “eco-friendly.” Almost none will tell you which statute applies to you, in which state, by which date. That’s the part we live in.

PFAS: banned, not “coming”

Intentionally added PFAS in food packaging is already illegal in California, New York, Washington, Vermont, Connecticut, Colorado, Maryland, Minnesota, Hawaii, Oregon, and Rhode Island — and in Maine as of May 25, 2026. The FDA pulled PFAS grease-proofing agents from the US market in 2024. If your wraps, clamshells, or takeout board still contain PFAS, they’re already illegal in a quarter of the country.

EPR: 7 states, and SB 54 has teeth

California, Oregon, Colorado, Maine, Minnesota, Maryland, and Washington have enacted packaging EPR. Oregon’s program is live and collecting fees. Under SB 54, registration closed June 1, 2026 and first producer reports were due July 1, 2026 — from January 1, 2027, unregistered producers cannot sell covered packaging in California at all. Penalties run up to $50,000 per violation, per day.

California SB 343 is scheduled to make the chasing-arrows symbol an unlawful claim on packaging that isn’t actually collected and sorted at scale in the state. Greenwashing stops being a PR problem and becomes a compliance one.

New US antidumping and countervailing duties — exceeding 540% for some Chinese producers of thermoformed molded fiber — took effect in January 2026, redirecting demand toward a limited set of unaffected origins and a domestic industry still building capacity. Where your fiber comes from now decides your landed cost.

Selling into Europe? PPWR applies

The EU’s Packaging & Packaging Waste Regulation applies to any packaging placed on the EU market — including from US exporters and ecommerce sellers. Recycled-content minimums, empty-space limits on parcels, and new labeling requirements phase in from August 2026.

Stateside Packaging was founded by Bryce Sessel-Glassberg, also the founder of T1 Affiliates, an agency working with US ecommerce brands. That work built the buyer network this firm runs on — the DTC and retail brands now staring down EPR fees and PFAS deadlines.
